Entered into force on June 1st, 2007, REACH stands for "Registration, Evaluation, Authorisation, and restriction of Chemicals." REACH is applied to all chemicals manufactured, imported, or placed on the market in the European Union in quantities of one tonne or more per year.

The key principle of REACH is that companies are responsible for ensuring that their substances do not pose a risk to human health or the environment. In order to do this, they need to gather information on the properties of their substances and assess the risks posed by them.

Based on this assessment, they may need to mitigate any identified risks. Companies also need to communicate this information down their supply chain so that users of their substances are aware of the risks and can take appropriate measures to protect themselves. Ultimately, REACH aims to ensure that only safe chemicals are used in Europe.

Any business that manufactures, imports, distributes, or uses chemicals must comply with the EU REACH regulation. This includes businesses of all sizes, from small businesses and sole traders to large multinational companies. In order to comply with the regulation, businesses must register their chemicals with the European Chemicals Agency (ECHA).

Once a chemical has been registered, businesses must comply with a range of obligations, including providing information on the safe use of the chemical and monitoring for any adverse effects.

The Forum for Exchange of Information on Enforcement, also called FORUM, is responsible for the enforcement of REACH in the EU, Norway, Iceland, and Liechtenstein. The FORUM is powered by the European Chemicals Agency (ECHA).

The FORUM aims to improve the level of enforcement of chemical legislation in the EU by exchanging information on good practices, methodologies, and tools; identifying training needs; and raising awareness of new and emerging risks.

There are a few total exemptions from the requirements for chemical safety under REACH and CLP. These include substances that are already regulated by other legislation, like:

  • Radioactive substances and substances in temporary storage under customs supervision that are not processed in any way
  • Substances used in defense are exempt when they are covered by national exemptions
  • Non-isolated intermediates are exempt from some requirements as they appear between two chemical reactions and are not removed from the system except for sampling purposes

Despite these exemptions, all companies must take measures to ensure the safety of their workers and the general public when handling hazardous substances.

Depending on the country, the European Union's REACH penalties can be administrative or criminal, or both. The harshest penalties include:

  • Withdrawal from the market
  • Imprisonment of up to 3 years
  • Fines of up to 55 million euros
  • Destruction of the substance product
  • Confiscation and deprivation of objects

While these are the most severe penalties, they are not the only ones. Others include lesser fines, community service, and probation. The specific penalty will depend on the country in which the offence took place, as well as the severity of the offence.
